This depends on who owns the trademarks. If the 'kim family trust' (or whatever the current legal title is) owns the trademarks, or owns, or has an interest in, a master license, or has some kind of contractual rights, there may be no choice but to pay the non-martial arts family. Of course, the head nationals could, upon Kim's death, have a miraculous awakening that they really don't need his name or images on the schools.

A cult certainly can worship a dead leader, like the scientologists and L. Ron Hubbard. A dead Kim could mean freedom to assert all sorts of things to him. He won't be around to dispute it!
